Due Process Hearings |
| The due process hearing is an impartial procedure used to resolve disagreements over issues related to special education services that arise between a parent and a school division. The right of the parent or school division to request a due process hearing is guaranteed by federal (http://www.ed.gov/offices/OSERS/IDEA/index.html) and state (http://www.pen.k12.va.us/VDOE/dueproc/dueprocess.shtmlL) laws governing the education of children with disabilities. The cost of a due process hearing is shared by the school division and the state department of education. The proceedings are at no cost to the parent, unless he/she chooses to hire an attorney. Further information to help individuals understand the steps for requesting and managing a due process hearing can be obtained from the Parent Resource Center, The Virginia Department of Education (804) 225-2013, or your attorney.
